These User Terms and Conditions (“Terms”) apply between you (“User” or “You” or “Your”) and Times Internet Limited (“TIL”) when You access the website 1838reserve.com and any related sub-domains or pages (the “Website”). The Website has been created solely to enable You to register Your interest in and join a waitlist for ICICI Bank 1838 Reserve Credit Card (“Card”). The Card is to be issued by ICICI Bank Limited (“Bank”). The Card are co-branded and marketed by both the Bank and TIL.
The Website does not issue, sell, or grant the Card. Your use of the Card, if and when issued to You, will always be governed by the applicable terms and conditions of the Bank, which may be updated from time to time. These Terms govern Your usage of the Website only and should be read in conjunction with the Bank’s terms and conditions.

Times Internet Limited is a limited liability company incorporated in India under the Companies Act, 1956. TIL presently has its registered office at 16-A, Lajpat Nagar-IV, New Delhi - 110024, India and Corporate Office at Plot No. 391, Udyog Vihar, Phase – III, Gurgaon, Haryana – 122016. TIL owns and maintains the Website, providing You access to and use of its features and services, all of which are subject to Your compliance with these Terms.
This document is an electronic record in terms of the Information Technology Act, 2000 (“IT Act”) and rules made thereunder as applicable and the amended provisions pertaining to electronic records in various other statutes as amended by the IT Act.
This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of a computer resource by a person.
Please note that by entering the OTP for authentication and/or by submitting the registration form on the Website, it will be deemed that You have read and understood these Terms and that You agree to accept and abide by these Terms.
By accessing or using the Website, You agree to abide by these Terms, which constitutes a legally binding agreement between You and Times Internet Limited. TIL’s role in relation to the Website is limited to enabling You to record and submit an expression of interest in the Card for onward transmission to the Bank. If You do not agree to these Terms, You must not provide Your information or express any interest to TIL in relation to the Card, and You must not access or use the Website.
Your access to and use of the Website may be subject to additional terms and conditions presented by TIL and/or the Bank, which may be notified to you from time to time.
You confirm that You are at least eighteen (18) years old, are capable and have the power to enter into a binding contract with TIL and are not barred from doing so under any applicable laws and reside in a jurisdiction where interest in the Card may be registered through the Website. You agree to register on the Website by providing Your true, accurate and complete details including Your name, age, email address, residential address, contact number and such other information as may be sought on the Website, before submitting Your expression of interest in the Card.
NOTE: Please read these Terms carefully. If You do not agree, You will not be able to proceed with registration or access the Website.
TIL may modify these Terms at its discretion without prior notice. It is Your responsibility to review these Terms periodically. Any changes will take effect upon posting on the Website, and continued use signifies Your acceptance of the modified Terms. If You do not agree with the changes, You should discontinue use of the Website.
The Website is an interest-registration and waitlist platform only. It allows the display of indicative information regarding the Card and enables Users to submit their details in order to express interest in the Card. As on the date of these Terms:
Information and features on the Website may be rolled out in phases at TIL’s discretion. TIL, the Bank and the respective Merchant reserve the right to introduce new offerings, as well as to modify, suspend, or withdraw existing or proposed products, services or offers, in whole or in part, without prior notice.
TIL acts solely as a technology and marketing facilitator in relation to the Website and the Waitlist. TIL is not a bank, non-banking financial company, or other regulated financial services provider, and does not provide or host the underlying banking, credit or Merchant goods and services.
If You find any of these Terms unacceptable or disagree with any content on the Website, Your sole remedy is to discontinue use of the Website.
You must be (1) at least 18 (eighteen) years of age, (2) capable of entering into legally binding contracts under applicable laws, and (3) resident in a jurisdiction where interest in the Card may be registered through the Website, in order to use the Website. By using the Website, You represent that You meet these eligibility requirements.
Meeting the above eligibility requirements entitles You only to register an expression of interest on the Website. It does not constitute eligibility for the Card, which shall be determined solely by the Bank in accordance with Clause 15 below.
Subject to Your compliance with these Terms, TIL grants You a limited, non-exclusive, non-transferable, and revocable licence to use the Website solely for personal and non-commercial purposes. This access shall remain in effect unless and until terminated by TIL. While accessing the Website, You may enjoy its contents for Your own personal, non-commercial purpose. You agree that You will not redistribute or transfer the contents of the Website. Except for such access, TIL grants no right, title or interest to You in the Website or its contents, and TIL and/or its licensors retain ownership of all copies of the Website and its contents. To join the Waitlist, You must register on the Website. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You indemnify TIL for any losses caused by inaccurate information and understand that TIL is not liable for any losses incurred due to such inaccuracies. TIL reserves the right to reject or terminate Your registration if Your information is found to be untrue, incomplete or misleading.
Upon registration, you need to share details including but not limited to your name, phone number, email address. Your login and registration credentials, if any, are for Your personal access only. You are solely responsible for maintaining the confidentiality of Your credentials and for all activity conducted under Your account, and You agree to indemnify TIL and the Bank for any unauthorised access or misuse. If You suspect that Your account has been compromised, You shall notify TIL immediately.
TIL may request additional confirmation or verification for any registration at its discretion, including authorisation by way of OTP or secure electronic record.
Any description, illustration, representation or indication on the Website of the Card’s proposed features, benefits, welcome benefits, spend milestones, rewards, privileges, memberships, or Merchant, brand or partner offers (collectively, “Indicative Features”) is provided purely for illustrative and promotional purposes.
TIL makes no warranties regarding Merchants or their offerings and shall not be liable for any losses or damages arising from Your transactions with Merchants. Merchants may bill You directly, and they will have their own terms and conditions governing their products and services, which may differ among Merchants. You are encouraged to review these terms and warranties with the Merchants.
If You wish to purchase products or services from a Merchant, You may need to provide certain information, including payment details, directly to the Merchant or its payment service provider. You agree that all information provided will be accurate and updated, and that TIL will not be liable for any losses resulting from Your dealings with Merchants.
The information made available in connection with the Card is provided by the Merchants and does not constitute an offer or guarantee of service, and TIL does not guarantee the availability of any products or services or the accuracy of any Merchant content. You agree to pay all charges incurred through Your registered credentials in connection with any Merchant transaction, including applicable taxes and shipping costs, if any. You agree that TIL's records of access, transactions, and activities will be deemed accurate and binding for all purposes and will not be challenged by You.
You are advised not to rely on the Indicative Features in making any financial or personal decision, and to refer to the final terms and conditions to be issued by the Bank at the time of actual issuance of the Card.
You agree that You shall not engage in any of the following prohibited activities while using the Website:
If You commit any of the prohibited acts, TIL reserves the right to suspend or terminate Your access to the Website and Your position on the Waitlist immediately, without notice and without any liability to TIL.
Once the Card is issued to You, and subject at all times to Clause 7 above (Indicative Card Features, Milestones and Merchant Offers), as a holder of the Card You may have access to services offered by TIL. These services will only become available once the Card is issued to You and are, in any event, subject to change, modification, addition, withdrawal or discontinuation as set out in Clause 7 above.
Clicking certain links within the Website may redirect You to the Bank’s, Merchants’ or other third parties’ websites or platforms without notice. TIL has no control over these external sites and assumes no responsibility for their content, availability, or performance. TIL does not guarantee that these links will function properly and provides them solely for convenience. Linking to external sites does not imply endorsement of their content, sponsors, or materials. TIL shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with accessing or using such other platforms or sites, or relying on any content, goods, or services available on those sites.
These third-party sites and platforms are governed by their respective terms and conditions and disclaimers. By accessing these sites, You agree to abide by them. You shall indemnify TIL against any disputes arising from Your violation of those terms.
No fee or payment is currently collected from You through the Website for registering Your interest in the Card or for joining the Waitlist. If and when the Bank approves issuance of the Card to You, any Joining Fee or other applicable charges shall be collected by the Bank directly, in accordance with the Bank’s own payment process and terms and conditions. TIL is not involved in, and shall not be liable for, the collection, processing, or refund of any such payment made to the Bank.
TIL is committed to protecting Your personal data. By using the Website and registering on the Waitlist, You consent to the collection, use, storage, processing, transfer and sharing of Your personal data as outlined in these Terms and in Our Privacy Policy, which forms an integral part of these Terms. This includes sharing Your information, including personal, contact and other data submitted by You, with the Bank and with third parties to facilitate the services or offers provided through the Website.
You irrevocably authorize TIL and Bank to access all information related to You, including personal data and details about Your use of the Website. Subject to the Privacy Policy, all information submitted via the Website will remain the property of TIL, Bank and the relevant Merchant(s).
The information submitted by You will be collected, used and shared for the Purpose. 'Purpose' means any purpose relating to, arising out of, or in connection with the Card, including the processing of Your registration and expression of interest, verification of Your identity and eligibility, communication with You, enabling the Bank to assess Your interest in and suitability for the Card, enabling the delivery of Card-related benefits and offers, compliance with applicable law, and any other purpose incidental or ancillary to the foregoing.
You expressly and irrevocably authorise and consent to TIL sharing the information submitted by You with:
You irrevocably authorise TIL and the Bank to access all information related to You submitted through the Website, including personal data and details about Your use of the Website. Subject to the Privacy Policy, all information submitted via the Website will remain the property of TIL, Bank and the relevant Merchant(s).
Any ideas, concepts, feedback, or suggestions voluntarily submitted by You to TIL through the Website (excluding Your personal data) may be used by TIL or its partners without obligation of confidentiality, and You grant TIL a non-exclusive, worldwide, perpetual, royalty-free licence to use, adapt, reproduce, modify, publish, translate, create derivative works from, and distribute the same.
All content, trademarks, service marks, trade names, logos, domain names and other intellectual property displayed on the Website, including the Card name and any associated branding used for reference purposes, are the respective property of TIL or its licensors or Merchant(s) or the Bank. All rights to the Website are reserved. You may not download, save, reproduce, store, or transmit any part of the Website including screens by any means, whether electronic, mechanical, or otherwise, without the express permission of TIL. You are also prohibited from using the Website in any manner that could cause confusion or deception among individuals or that disparages or discredits TIL, any Merchant, any service provider or the Bank.
Upon registration on the Website, You agree to receive alerts, emails, SMS, WhatsApp messages and push notifications from TIL and/or the Bank regarding Your registration, Your position on the Waitlist, the status and launch of the Card, Merchant offers as and when notified, and any other matter as may be decided by TIL.
Registration on the Waitlist, expression of interest, and/or submission of Your information through the Website does not in any manner guarantee, assure or entitle You to issuance of the Card. This is merely an expression of interest and not an application for the Card.
If and when the Card is proposed to be issued, You may be required to make a separate application to, and satisfy the requirements of, the Bank, including providing additional details, information and documents as may be required by the Bank from time to time. The acceptance or rejection of any application for the Card is solely the Bank’s decision, taken in accordance with the Bank’s own credit, underwriting, Know Your Customer (KYC), risk, regulatory and internal policies. TIL has no role in that decision, cannot assist You with any issues regarding Your application with the Bank.
TIL reserves the right to reject Your registration, remove You from the Waitlist, or take any other action it deems appropriate (including reporting to the Bank or the appropriate authorities), where TIL detects or reasonably suspects any misrepresentation, fraud, or provision of false or misleading information by You.
You acknowledge that being placed on, or accepted onto, the Waitlist creates no right, legitimate expectation or claim against TIL or the Bank for issuance of the Card, and neither TIL nor the Bank shall be liable for any loss, damage, cost or inconvenience arising from non-issuance of the Card, delay in issuance, or the imposition of any eligibility criteria by the Bank.
Access to and use of the Website, including all content, information, related sites, and any facilities and services provided or available through the Website, are undertaken at Your own risk. The Website is provided by TIL on an ‘as is’ and ‘as available’ basis without any representation or warranty of any kind, express or implied, including but not limited to warranties regarding availability, accuracy, usefulness, or completeness of information, facilities, products or services, continuity, title, non-infringement, freedom from computer viruses, merchantability, or fitness for a particular purpose, uninterrupted access, timeliness, quality, performance, except as prohibited by applicable law.
Without limiting the generality of the foregoing, TIL makes no representation or warranty that: (a) the Card will be launched at all, or launched within any particular timeframe; (b) the Card will carry any particular feature, benefit, milestone, reward or Merchant offer; (c) any Indicative Feature will survive to launch or remain available thereafter; or (d) You will be issued the Card. TIL reserves the right to modify, postpone, suspend or abandon the Card’s Waitlist process at its sole discretion at any time, without liability to any User.
TIL has not verified and shall not be liable for any content, information or advertisements of third parties or Merchants on the Website or any hyperlinked sites or platforms. While TIL implements security measures it deems appropriate, it does not guarantee that unauthorised access to the Website or User records will be prevented, and shall not be liable for any unauthorised access or hacking incidents.
This disclaimer extends to any damage or injury resulting from performance failures, errors, omissions, interruptions, defects, delays, computer viruses, communication line failures, theft, destruction, or unauthorised access to and use of records, whether arising from breach of contract, negligence, or other causes. The information and views provided are based on sources believed to be reliable, but neither TIL nor its information suppliers or Merchants assume responsibility for accuracy or for any losses arising from the information contained herein. Communications on the Website do not constitute an investment solicitation or endorsement of any product or service.
TIL does not warrant or represent the use or results of using any product, service, or facility concerning compatibility, correctness, accuracy, reliability, or otherwise.
You acknowledge that any warranties related to facilities, products, or services described on the Website are solely provided by the respective owners, advertisers, manufacturers, suppliers, or Merchants not by TIL (unless expressly stated otherwise).
TIL operates the Website on a no-liability basis. TIL shall not be liable to You or any third party for any direct, indirect, incidental, special, exemplary, punitive, consequential, or other damages, including but not limited to loss of profits, loss of opportunity, data corruption, loss of goodwill, or business interruption, arising from or in connection with the Website, the Waitlist, the non-issuance of the Card, the modification or withdrawal of any Indicative Feature or Merchant offer, or any Service or transaction associated with the Website, regardless of the basis for any claim.
If any disclaimers or limitations of liability in these Terms are deemed unenforceable, TIL’s maximum aggregate liability to You in connection with the Website shall not exceed the fees paid by You for the products or service ordered or obtained through the Application and give rise to the liability.
TIL is not responsible for any inability to access the Website or any misuse thereof, and shall not be liable for temporary interruptions on the Website due to technical difficulties, maintenance, testing or updates, including those required to reflect changes in relevant laws and regulatory requirements.
TIL is not liable for any banking or credit related issues arising with respect to the Card or any application therefor. All Bank related queries or issues shall be raised by You directly with the Bank at the Bank’s helpdesk, the details of which are set out at 1800 1080 and customer.care@icici.bank.in.
Search results displayed by the Website are automated and cannot be pre-screened. Therefore, TIL assumes no responsibility for the accuracy of any search results or content from linked sites. TIL is not liable for any unauthorized interception of emails to or from You.
To the extent permissible, the disclaimers, limitations on liability, and indemnities available to TIL under these Terms shall also apply to the Bank, its Merchants and service providers, including their respective directors, officers, employees, agents, successors, assigns, consultants, sponsors, and affiliates involved in the creation or management of the Website. However, this clause does not shield these individuals or entities from their obligations and liabilities to TIL.
The Website may contain inaccuracies or errors, and unauthorised alterations by third parties may occur. While TIL strives to maintain the integrity of the Website, it does not guarantee its sequence, timeliness, completeness, correctness, or accuracy. If You notice any inaccuracies, please inform TIL for correction.
You agree to indemnify, defend, and hold harmless TIL, the Bank, Merchants and their respective affiliates, officers, directors, and employees from any claims, losses, liabilities, damages, costs, or expenses (including attorney fees) arising out of or in connection with Your use of the Website to the detriment of TIL, the Bank or any Merchant, Your submission of false, inaccurate or misleading information, or Your violation of these Terms or of any applicable law.
TIL reserves the right to modify these Terms (including any additional terms and conditions incorporated by reference herein) at any time. Any changes will be effective immediately upon posting on the Website. Your continued use of the Website after any changes made by TIL indicates Your acceptance of the modified Terms.
These Terms and Your use of the Website do not create any agency, partnership, joint venture, or employer-employee relationship between You, TIL, any Merchant, or the Bank unless expressly stated otherwise.
TIL is not required to monitor the Website. However, You acknowledge and agree that TIL has the right to monitor the functioning of the Website, electronically or otherwise, and to disclose any information as necessary to comply with laws, regulations, or governmental requests, ensure proper operation of the Website, or protect itself, the Bank, Merchants, its visitors, or Users. TIL will not intentionally monitor private communications unless legally required. TIL may remove any content deemed unacceptable or unlawful at its discretion.
You acknowledge and agree that TIL may, without prior notice, suspend or terminate Your registration, credentials, account or position on the Waitlist, or deny access to all or any part of the Website, where TIL believes, in its sole discretion, that Your conduct violates these Terms, infringes TIL’s rights, or is otherwise inappropriate. This includes but is not limited to circumstances such as Your death, bankruptcy, lack of legal capacity, or any factors affecting Your creditworthiness, as determined by TIL.
Without limiting the generality of the foregoing, You will be removed from the Waitlist and Your registration may be terminated by TIL where:
You also agree that TIL may deny access to materials stored on the internet or third-party services through the Website, without any obligation to notify You or third-party providers, and shall not be responsible for any consequences arising from such denial.
TIL’s decision in this regard shall be final. If TIL terminates these Terms or suspends Your access to the Website, You agree that TIL shall, subject to applicable laws, have no liability or responsibility to You.
The provisions of these Terms that either explicitly or by their nature must remain in effect even after termination of these Terms shall survive termination.
Failure by TIL, any Merchant or the Bank to enforce any right or provision of these Terms does not constitute a waiver. Any waiver must be in writing and signed by TIL, the Merchant or the Bank, as applicable. A waiver on one occasion does not prevent enforcement on future occasions.
If any provision of these Terms is deemed invalid or unenforceable, it will not affect the remaining provisions of these Terms, which shall remain valid and enforceable. The parties shall endeavour to give effect to the parties’ intentions as reflected in these Terms, to the extent possible.
Notwithstanding any statute or law to the contrary, but to the extent permitted by law, any claim or cause of action arising out of or related to access to or use of the Website, the Waitlist, or these Terms must be filed within three (3) months after such claim or cause of action arose, failing which it shall be forever barred.
TIL may give notice to You via email, letter, phone, or other methods as TIL may deem fit, to the last address or contact details You provided. You may send notices to TIL in writing via hand delivery or post to the address listed on the Website. TIL may choose to, but shall not be bound to, act on any communications received from You through various channels, including email.
TIL may, but shall not be bound to, publish general notices applicable to all Users in a newspaper or on the Website, which will have the same effect as individual notices.
Documents sent electronically between the parties may include emails, email attachments, or downloadable files from the Website. TIL will consider any communication or document duly delivered if sent to the email address You provided. TIL may act on any instructions received from You via email or other electronic means, including the internet.
Clause headings in these Terms are for convenience only and do not affect the interpretation of any provision. TIL may subcontract or employ agents for functions related to the Website and its obligations.
TIL may send You information about products and services offered by it, the Bank, the Merchants or any other entities via email, phone or other means. You are responsible for Your own internet access and any associated costs, as well as for having the necessary equipment. Content on the Website may vary based on Your browser limitations.
The Website, these Terms, all transactions entered into on or through the Website and the relationship between You and TIL shall be governed by and construed in accordance with the laws of India and no other nation, without regard to the laws relating to conflicts of law.
You and TIL agree that all claims, differences and disputes arising under or in connection with or pursuant to the Website, these Terms, any transaction entered into on or through the Website or the relationship between You and TIL shall be referred to arbitration under the Arbitration and Conciliation Act, 1996 (as updated). For the purpose of such arbitration, there shall be 1 (one) arbitrator appointed by mutual consent. The venue of arbitration shall be New Delhi, India. The arbitration proceedings shall be conducted in English. Any award made in such arbitration will be final and binding on the parties. Each party shall bear its own costs of the arbitration. The courts at New Delhi shall have exclusive jurisdiction regarding any issue arising out of these Terms including in respect of any interim reliefs, and You hereby accede to and accept the jurisdiction of such courts.
TIL accepts no liability whatsoever, direct or indirect, for non-compliance with the laws of any country other than that of India. The mere fact that the Website can be accessed in a country other than India would not mean that the laws of such country would be applicable.
